Avery McDaniel has successfully tried over 140 cases to a jury. We have handled many personal injury cases that have resulted in large verdicts and settlements for our clients.   • $5,000,000 judgment against a company and the company’s female softball coach who sexually assaulted one of her female players.
  • $1,900,000 settlement against a large trucking company for our clients’ whose family member died in a trucking accident.
  • $1,250,000 settlement against a property management company and major insulation manufacturing company for our clients’ son who died as a result of code violations and a dangerous product.
  • $950,000 settlement against a property management company for our client who was sexually assaulted by a property management employee.
  • $950,000 settlement against a general contractor for failing to keep a safe worksite resulting in our client falling from a skylift.
  • $750,000 settlement against a property management company for our client who was sexually assaulted by a property management employee.
  • $300,000 settlement against a property management company for failing to provide proper window latches on a client’s apartment allowing a perpetrator to enter and attempt to rape the client.
  • $300,000 settlement against a homeowner who failed to properly light and notify our client that their pool was under construction resulting in injuries to our client.
  • $250,000 settlement against a company for a non-subscriber to the worker’s compensation for an employee who was injured in a single vehicle accident for negligently maintaining the vehicle.
  • When a client was arrested for DWI and police officers forcibly withdrew her blood our office took the case and had the blood results thrown out. This case has become the landmark case in Texas as to whether police officers are qualified to take blood from DWI suspects. Our office has successfully defended the appeals of the State of Texas and the case is currently pending in the Court of Criminal Appeals. We anticipate that this case will be appealed to the United States Supreme Court for final determination.
  • When a member of the new Black Panthers was falsely accused of displaying a firearm the new Black Panthers hired the Law Office of Avery McDaniel to take the case to trial. After a lengthy trial, an all white jury agreed and found the new Black Panther’s member not guilty.
  • When a CEO of a multi-national company was accused of breach of fiduciary duty in a shareholder derivative lawsuit by a member of the company our firm was hired to defend him in a civil action and an arbitration proceeding. We successfully disqualified the member from prosecuting the lawsuit and successfully defended his Petition for Mandamus to the Court of Appeals. Our firm was also successful in having the arbitration proceeding dismissed.
  • Our firm successfully defended a real estate dispute on behalf of a real estate developer client where a property owner made a $750,000 initial demand. Our firm successfully defended the case and the jury awarded the property owner zero damages and awarded our client, the real estate developer, $70,000 in attorneys’ fees.
  • Our firm successfully tried a breach of contract case before a jury for a corporate manufacturing client to recover damages for merchandise not paid for by its client.
  • Our firm successfully defended a national company and its employees in a Texas lawsuit and injunction where a competing company alleged that its former employees (our clients) misappropriated confidential information and client lists and violated non-solicitation and non-competition agreements.
