Avery McDaniel


To date, Avery has helped many people and businesses through different issues, which include criminal matters, personal injury cases (like auto accidents, trucking accidents, wrongful death, and product liability), business litigation, real estate litigation and general civil/commercial matters. Some issues have been resolved through negotiation, mediation or, if needed, a trial. Out of thousands of cases, most of his client’s cases were resolved without a trial. However, when needed Avery has tried issues to a jury. In fact, Avery has tried over 140 jury trials in both State and Federal Court.


Avery received an “AV” rating from his peers as determined by Martindale-Hubbell’s ratings for legal ability and ethical conduct. Avery has also been recognized for his ability to negotiate and was asked to participate in a training session for the military by helping the military develop negotiation skills to successfully mediate governmental issues.


Avery’s success in negotiations has helped his clients negotiate dismissals of criminal actions, favorable plea bargains, and in the civil context, millions of dollars in settlements, and to resolve complex civil/commercial litigation cases.


However, when negotiation failed, Avery has successfully received “not guilty” verdicts, million dollar judgments, injunctions and declaratory relief through the court system. Avery fights for all individuals, whether the claim is a multi-million dollar claim or a smaller claim. However, sometimes the fight does not end with a jury verdict.


Avery has appealed and defended verdicts to the Court of Appeals on both criminal and civil matters and has had issues go to the highest courts of our state and the United States Supreme Court.
